In the first information report filed in 2020 by the Cyber Cell of the Mumbai Police in the porn film racket investigation, the Bombay High Court granted temporary protection from arrest to tycoon Raj Kundra. Kundra’s lawyer, Prashant Patil, contended that the co-accused in the FIR had already been released on bail. He further contended that the charges against Raj Kundra were all punishable by less than seven years in prison and that the application should thus be granted.
In response to the plea, Additional Public Prosecutor (APP) Prajakta Shinde argued that the accused’s position in the case was distinct from that of the other defendants. She requested extra time to get more information about the application’s merits. Justice Sandeep K Shinde granted her time and issued an interim order. Preventing Kundra from being arrested until the next hearing date, which is August 25, 2021.
In the October 2020 FIR filed by the Mumbai Police Cyber Crime Department in connection with the transmission of nude pornographic content on the OTT platform, Kundra has requested pre-arrest bail.
Sections 292, 293 of the Indian Penal Code (selling of obscene material), Sections 66E, 67, 67A of the Information Technology Act (transmission of sexually explicit material). Provisions of the Indecent Representation of Women (Prohibition) Act were also charged in the FIR.
Kundra said that he was wrongfully accused in the case by the Cyber Cell. It is attempting to link him to the crime. He claimed that the prosecution has presented no proof linking the Hotshot app to the alleged crimes. None of the actresses who were arraigned as defendants in the case had had any objections.
Kundra was apprehended in a similar FIR filed by the Crime Branch in 2021 for identical offenses. He claims that the charges in the charge sheet submitted in the 2021 case. The current FIR are identical, giving him the impression that he will be arrested in this case as well. He is already detained in connection with a 2021 FIR filed for similar offenses.
Kundra went to the High Court after his anticipatory bail motion was denied by a Mumbai Sessions Court.
In another FIR in the porn film racket case, the High Court recently denied his appeal. Challenging his remand to custody and subsequent orders of the Metropolitan Magistrate.
