After being detained by Mumbai Police on suspicion of circulating pornographic videos on mobile apps, Shilpa Shetty’s husband has been sent in judicial custody till July 23. Raj Kundra lawyer claimed in court on Tuesday that categorizing “vulgar content” as pornography is inappropriate in the highly contentious Raj Kundra pornographic case.
He further argued that Section 67A of the Information Technology Act, as well as other portions about pornography, should not be applied to the transmission of obscene information in electronic form, because these regulations categorize “actual intercourse” as porn and the rest as “vulgar content.”
Raj Kundra Lawyer Argues In Court
According to reports, the lawyer went on to defend the content. Kundra’s Lawyer claimed that the investigating authorities are monitoring what’s trending on the internet these days: filthy content. However, it is not deemed pornographic. No footage portrays two individuals engaged in sexual behavior, according to the lawyer, thus it cannot be classed as porn.
He also stated that Kundra’s arrest was illegal. Claiming that an arrest should only be conducted when the investigation cannot progress without it. However, in this case, the accused was compelled to help with the investigation following his detention.
Kundra has asked for an anticipatory release in the case, and the police have discovered no proof that Kundra’s wife, Shilpa Shetty, is implicated.
Businessman Raj Kundra was detained on Monday for allegedly producing and distributing pornographic videos using mobile applications. He has been remanded in judicial custody with his companion Ryan Tharp until July 23.
